So that second half of the sentence is WTF, but let's focus on the first clause. Since when is there a "legal limit" for blood alcohol content? It doesn't sound like he was driving. Has the nanny state decided to remove citizens' freedom here, or is this just really crappy reporting?

They're probably referring to 0.08% BAC which is the minimum to be declared legally drunk. It's most likely an umbrella term for many legal definitions.

I was going to suggest "public intoxication", but apparently Kansas has explicitly banned its communities from enacting public intoxication laws.
