Not sure how BLM is a bigger threat to civil liberties when historically the biggest threat has always been governments. The Founding Fathers understood that so they tried to limit the federal government's ability to infringe on them by creating the Constitution.

Personally I'd argue religion has that distinction, since ideological leaders bend governments to their purpose. Ideology is much more pervasive than government, infecting not just the police and the judges, but also the juries, HR departments, social media curators, etc.
This is the bigger issue. They are using the grey areas around detainments (mainly length of time before charges are required) at a time when people are already protesting police tactics. I have a feeling that there will be lawsuits over the legality of these detainments and those lawsuits will probably be combined to go all the way to the Supreme Court. If it reaches the current panel of Justices it may not end well for Trump's administration.
