Indiana law does not prohibit public officials from using personal email accounts,although the law is generally interpreted to mean that official business conducted on private email must be retained for public record purposes.

So, technically he wasn't breaking federal law, or even state law. Yes, he should have made 100% sure to do the forwarding protocol to send all government-related emails to a records account for easy search. I would laugh so hard if the Democrats try to bring this out against Pence though vs the Hillary email issues though. That would be them digging their own grave.
