Well if I attempt to solicit a hit man to kill my wife, I'm still going to jail, regardless if he succeeds or not.
And if that is true, than by all means, whatever needs to be investigated should be. As with all of this, it's simply a determination if the evidence available has merit, and if so, exactly how much?
