And holy crap I didn't know about this "pretzeling" of the EULA into copyright infringement. I've never really thought about it but I guess in the courts you can truly argue anything as long as the wording is twisted enough. That second comment in the follow-up article you linked gives a lot of info on that. I didn't read through the court documents, which reveals that kid was maliscious and knew exactly what he was doing.
