They don't care if it is constitutional. In fact they despise the constitutional constraints that prevent them from reshaping the country how they please. They just see how it currently benefits them.

I would imagine that a non-NPVIC state's Governor would sue to stop the ratification of the election until the USSC could rule on a clearly unconstitutional action.
