If Furie wins it will be limited to part of the merch proceeds and possibly attorney fees. Of course the issue is that various permutations of the pepe character are prevalent and may fall under parody/fair use, for example Honkler would most likely be considered an original character.
Also if Furie pulls the politics/hate speech card Jones has gone on record stating that frogs are gay.

I foresee it being very difficult for Furie to win this. He allowed Pepe to be used for over a decade in all sorts of memes and merchandise. Inaction on his part is equivalent to relinquishing your claims to your IP. It's reasons like this why say Blizzard sends cease and desist letters to people running emulation servers for WoW because their inaction would cause them to lose copyright claims on WoW.
