How are Airbnb and Uber legal? I'm not calling for them to be investigated because I believe they successfully fill a niche. Like lemonade stands.

If you're a business entity you are regulated and file taxes as a business. If you are a residence or operate your own vehicle then you file as an individual, owing no business taxes, and are not similarly regulated.

These types of companies operate as if they are individuals not generating an income, which opens the actual individual operators to legal issues (IRS, DMV, insurance, mortgage/car loan, etc.). It's surprising this hasn't been settled.

Remember this is about Japanese law, but your question is important for the USA

Basically, "everything is legal unless forbidden", vs the old Soviet style "everything is forbidden unless permitted."

Correct. In the US we are granted rights by our Maker, and we decide to grant the government an ability to restrict some of these rights, upon review.
